Our Lawyers have served as lead lawyers in a variety of different matters. We have not only served our clients well, but have been appointed as liason counsel to the courts in a variety of litigation. Most recently, Jason Byrd served as liason counsel to the Jefferson and Harris county courts with regard to all Hurricane Ike matters.
Although each case may have its specific facts, strengths and weaknesses, our lawyers maintain tremendous focus on our client’s matters whether we are at the negotiating table or trying a case to a jury. Some examples of our lawyers’ recent successes include the following:
- Served as lead counsel in first Hurricane Ike claim to go to trial. The matter involved a church claim and was pending in Federal Court. The case was settled for a confidential seven-figure sum during the second day of trial.
- The Byrd Law Firm lawyers Jason M. Byrd and Amy Sanderson Guseman secured an arbitration award for over $2.9M. The award, in addition to amounts recovered on behalf of their client prior to the arbitration, totaled nearly $3.4M in gross recovery. The underlying dispute involved a property insurance claim where TBLF’s client had been paid nothing on the claim prior to our lawyers’ involvement. The Plaintiff had made claims for breach of contract, violation of the Texas Insurance Code and breach of the duty of good faith and fair dealing.
- Served as lead counsel for a minority shareholder in a multimillion dollar closely held corporation after the minority shareholder was squeezed out by the majority shareholder. The majority shareholder initiated the lawsuit and demanded substantial amounts of money from the minority shareholder. In less than six months, we resolved the matter favorably on behalf of our client under confidential terms and the result was a dismissal of all claims by the majority shareholder against the minority shareholder and the transfer of significant assets including cash and real estate holdings to our client. The total settlement was valued at a seven-figure amount.
- Served as lead counsel for over 1,200 property owners in claims against their own insurance company following Hurricanes Rita and Ike.
- Served as lead counsel for a Houston church against their insurer following Hurricane Ike. The insurer demanded appraisal to resolve the claim. Our lawyers thwarted this request at the trial level and the defendant appealed. We won the appeal and the case was remanded to the trial court. The case was then resolved favorably for a confidential seven figure amount.
- Served as lead counsel for a small distributor of oil related products in a dispute with the much larger manufacturer of the products after the manufacturer took steps to force our client out of his business. This matter was successfully resolved on behalf of our client in less than three months. This matter was resolved for a confidential six-figure amount.
- Serving as lead counsel for numerous Hurricane Ike victims with “slab claims,” we actively participated in the negotiation of all Hurricane Ike slab claims against Texas Windstorm Insurance Association. The negotiation resulted in an approved settlement of $189M for all slab claims.
- Served as lead counsel for over four hundred clients in three states (Texas, Louisiana and Mississippi) against Countrywide Home Loans/Bank of America for its practices in handling their mortgage accounts. This representation resulted in a confidential seven-figure settlement for not only our clients, but spurred the resolution of similar claims for a 20,000 member class of claimants.
- Served as lead counsel for a local distributor in a dispute with its insurance carrier. The result was a confidential settlement in excess of $500,000.
- Served as lead counsel for a local church in a dispute with its insurance carrier. The result was a confidential settlement in excess of $500,000.
- Served as lead counsel for a local resident engaged in the rental real estate business in a dispute with his insurance carrier. The result was a confidential settlement in excess of $800,000
- Served as lead counsel for local oil and gas and land broker. We were able to resolve this matter through focused and aggressive representation six days into the litigation. The settlement was for a confidential six figure amount and resulted in our client receiving everything demanded in the lawsuit.
- Served as lead counsel for a Houston church in a dispute with its insurance carrier. The result was a confidential settlement in excess of $400,000.
- Served as lead counsel for Port Arthur apartment complex in a dispute with its insurance carrier. The result was a confidential settlement in excess of $350,000.
- Served as lead counsel for homeowner in a dispute with its insurance company. The result was a confidential settlement in excess of $195,000.
